## Renting out a flat, and the law that protects the tenant

Spanish tenancy law gives a residential tenant a minimum term that runs well beyond the twelve months most contracts say, and it is not something the parties can simply agree away. Owners who let a flat long term here sometimes discover that at the moment they wanted it back for the summer.

The distinction between a residential let and a holiday let is therefore not a formality, it is two different legal worlds with different contracts, different tax treatment and different rights for the person in the flat. Get the contract drawn by somebody who does this locally rather than downloading one, because the version that circulates online is usually written for the other side.
